Mass Surveillance in Pakistan

The investigation by Privacy International reveals that since 2005 Pakistan has been building mass surveillance, the technology obtained from surveillance companies including Alcatel, Ericsson, Huawei, SS8 and Utimaco. In 2013, the intelligence agency of Pakistan planned to tap international undersea cables that would allow Pakistan to collect and analyze data traveling through a country.

Eventually, the government set out to build a filtering system capable of blocking 50 million URLs, an initiative that was later withdrawn.

In 2014, the leaked documents revealed that the Pakistani authorities installed FinFisher, a surveillance software that is used for advanced online monitoring, spying and filtering. FinFisher is designed to access and remotely control target devices, hack into WiFi networks to extract SSL traffic, usernames and passwords, and to infect desktop, mobile and USB devices for surveillance purposes.

Online Censorship in Pakistan

The authorities impose selective restrictions on civil liberties, intimidate and interfere with the media, and enjoy impunity for violence against opposition groups and religious minorities. The military exerts immense influence over security and policy issues. In recent years, the government targeted independent journalists and media outlets for raising issues that critique the current government or report on rebellions, by imposing fines, banning or persecution. Between 1992 and 2020, 61 journalists were killed in Pakistan, comparing to, for example, 2 in a highly surveilled Kingdom of Saudi Arabia, 4 in Iran, or 69 in Somalia.

The Pakistan Telecommunication Authority (PTA), controlled by the government and the military, is the only entity that manages both telecom and Internet services in Pakistan. The 2016 Prevention of Electronic Crimes Act (PECB) gives PTA unlimited powers to censor online content. PECB prohibits dissemination of blasphemous content and porn, critique of the government, military and judiciary system, terrorism and protects national interests. Under PECA, PTA has already banned about a million of websites.

In order to disrupt various key political events and demonstrations, the government of Pakistan uses temporary Internet disconnections and slowdowns. To prevent criticism of the Pakistani government and military, TV networks broadcast live streaming with a 10 second delay. In 2010, Facebook, YouTube, Flickr, and Wikipedia partially or fully blocked, a reaction to “Everybody Draw Muhammad Day”.

In 2011, Pakistan banned encryption and VPN. Same year mass blocking of pornographic content was implemented as a response to a media report that indicated Pakistan to be the top country to search for porn.

In March 2012, the government requested proposals for a nationwide Internet firewall. 2012 was a year of multiple attempts to ban social media and video content. Pakistan went with another ban on YouTube because of a controversial movie “Innocence of Muslims”, on Twitter over cartoon images of Mohammed, the prophet, blocked a number of websites over a political scandal, and froze mobile phone networks in the province of Balochistan.

In 2016, The Prevention of Electronic Crimes Act (PECA) 2015 has been passed by a National Assembly, a bill that would eventually create legal framework to limit free speech, online censorship and mass surveillance. The law threatens privacy and freedom of speech by censoring online content and criminalizing online activities. Additionally, PECA has extensive user-data retention clauses that requires ISPs to retain user data for a year, which means that Pakistani ISPs log everything that you do online and store the records for at least 1 year.

A section of the legislation also authorises the government to share user data with “any foreign government, 24×7 network, any foreign agency or any international organisation or agency”, without defining those entities.

On May 25, 2017, Pakistan announced yet another law that would severely restrict online anonymity by linking the social media accounts to phone numbers, that require fingerprints to be registered.

On May 20, the Pakistan’s Federal Investigation Agency (FIA) arrested six people for online comments.

Over the past few years, the authorities drastically increased the number of requests to remove content from Facebook, Twitter and YouTube. In 2020, Pakistan moved to approve yet another censorship and surveillance legislation, the Citizens Protection (Against Online Harm) Rules, that would require social media websites to remove “undesirable” content immediately as requested, while also providing full account data and encrypted messaging history of Pakistani citizens. Additionally, the companies are to setup data centers and physical presence in Pakistan. In response, Google, Facebook, Twitter, Apple and Amazon threatened to leave the country.

In their attempts to have full control over multimedia circulating within the country, the PEMRA, Pakistan Electronic Media Regulatory Authority, proposed a bill that would require online video sites to obtain a license to operate.

Later the regulators blocked the streaming app Bigo on “complaints of immoral, obscene and vulgar content”, TikTok was issued a final warning on the same grounds.

Pakistan set a deadline to register VPN with the ISPs. As per new regulations, any unregistered, encrypted traffic passing through the Internet will be blocked after the deadline.

VPN users can register their VPN by filling two forms with their ISPs, and only companies with legitimate usage are eligible to register. The corporate users must indicate their static IP address, specify VPN software, purpose and business details.

This essentially means that non-businesses are not able to legally register or use VPN in Pakistan. Which means that, after the deadline, unregistered VPN for personal use will no longer function.

Pakistani users have already reported issues with their VPN being either throttled or completely blocked, which comes as no surprise since the authorities have invested into advanced filtering systems capable of DPI (deep packet inspection) to identify and block VPN traffic.

Pakistan is not alone in their attempts to control the Internet, however. The Middle East, China and some parts of Africa are notorious for their country-wide VPN ban and aggressive online censorship. Nevertheless, there are VPN services that have implemented advanced methods capable of bypassing strict firewalls, while also hiding VPN traffic from even the most advanced systems.

Generally, they use some sort of VPN obfuscation (masking) to blend OpenVPN with regular SSL traffic and send VPN protocols over port 443 that is normally reserved for encrypted browsing. It’s highly likely that, once the ban is in place, normal OpenVPN traffic going over port 1194 will no longer work in Pakistan. This is the reason why we recommend using VPN services that offer advanced VPN masking capabilities and send all VPN traffic over port 443.
