The Patriot Act additionally provided legal framework for the US government agencies to share information related to potential terrorist threats.

In June 2015 US Congress approved the USA Freedom Act, a bill placing restrictions and oversight on the NSA surveillance. While USA Freedom Act put an end to NSA mass monitoring, the law did not stop private entities from gathering the data. Although passing mandatory data retention legislation in the US failed, phone records, emails and Internet browsing is still being logged by telecom companies. In order to gain access to this information, the NSA has to provide a reasonable suspicion that a specific individual, account or device is associated with the terrorism.

Therefore, USA Freedom Act seemingly limited government agencies’ access to personal data that private companies collect. But in late 2015 Congress passed yet another law, CISA, that was designed to protect businesses from legal liability in cases when they volunteer to hand over intelligence information to the federal government.

Which means that US based businesses can now legally violate their Privacy Policy and Terms of Service and regularly provide sensitive user info to the Department of Homeland Security that can then share it with the DoD, NSA and other entities. In addition to this, there is virtually no transparency or individual accountability.

As a result, US Patriot Act along with the Gag Order and CISA basically neutralize US privacy laws making the United States one of the worst jurisdictions for privacy. It’s worth noting, however, that the US government only enforces Patriot Act and Gag Order in high-profile cases mostly involving national security.

Even though EU has been known to be a part of the global surveillance alliance, EU has strong privacy laws protecting their citizens. Unlike the United States and the United Kingdom, European governments cannot secretly force private companies into spying on their users. Once a court warrant has been served, a VPN provider based in EU is required by law to inform their users about the subpoena. This means that EU VPN providers cannot violate their privacy policy, cannot secretly hand over data on their users because if they do, the user can sue them. Illegally obtained evidence cannot be used in a court of law.
